Terms and Conditions

Last updated: August 2026

1. Scope

These Terms and Conditions apply to all orders placed through the Amy & Co. online store and to all resulting contractual relationships between us and our customers.

The seller and contracting party is:

Denise Tröstner
trading as Amy & Co.
Sankt Georgener Hauptstraße 65D
7000 Eisenstadt
Austria

Email: info@amyandco.shop

These Terms and Conditions apply to both consumers and business customers, unless expressly stated otherwise below.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

A business customer is any natural or legal person, or partnership with legal capacity, acting in the course of their trade, business or self-employed professional activity when entering into the contract.

Mandatory statutory consumer rights remain unaffected by these Terms and Conditions.

2. Offers and Formation of Contract

The presentation of products in our online store does not generally constitute a binding offer, but rather an invitation for customers to place an order.

Customers can select products, add them to their shopping cart and review or correct their order details before submitting the order.

By clicking the final order button, the customer submits a binding offer to purchase the products contained in the shopping cart.

After receiving the order, we send an electronic order confirmation.

The purchase contract is concluded when we expressly accept the order, confirm or initiate payment in accordance with the selected payment method, or begin processing or shipping the order.

If we are unable to accept an order, we will inform the customer. Any payments already received will be refunded.

3. Ordering Process and Input Errors

Before submitting a binding order, customers may review and amend the information entered in the shopping cart and checkout using the functions provided.

The languages available for the conclusion of the contract depend on the language versions offered in our online store.

Contract-related information, order confirmations and other communications may be sent electronically to the email address provided during the ordering process.

Customers are responsible for providing a correct and accessible email address and complete billing and shipping information.

4. Products and Product Presentation

We make every reasonable effort to present our products, including colours, dimensions, materials, features and other characteristics, as accurately as possible.

Depending on the device used, display settings, lighting conditions or production-related variations, colours and appearance may differ slightly from those shown in the online store.

The product characteristics stated at the time of ordering are decisive.

Minor deviations that do not impair the ordinary use of the product and are legally permissible remain reserved.

Statutory warranty rights are not affected.

5. Prices

The prices displayed in our online store are total prices.

Where VAT applies under the relevant tax regulations, it is included in the displayed final price.

Additional shipping costs may apply where indicated. Any applicable shipping costs will be shown no later than before the customer submits a binding order at checkout.

The price applicable to an order is the price displayed in the online store at the time the order is placed.

We reserve the right to change prices for future orders.

6. Deliveries Outside the European Union, Customs Duties and Import Charges

For deliveries to countries outside the European Union, additional customs duties, import taxes, handling fees or other governmental charges may apply.

Whether such charges apply and who is responsible for paying them depends on the destination country and the shipping and customs clearance method applicable to the relevant order.

Unless such charges are expressly shown at checkout as being covered by Amy & Co. or included in the total price, they may be payable by the customer.

Customers outside the European Union are advised to familiarise themselves with the applicable import regulations in their country where necessary.

7. Payment Methods

The payment methods currently available are displayed at checkout.

Depending on availability, these may include in particular:

  • credit and debit cards, including Visa, Mastercard and American Express
  • Apple Pay
  • Google Pay
  • Shop Pay
  • PayPal
  • Klarna or other payment services offered at checkout, where available

There is no entitlement to the permanent availability of any particular payment method.

Where an external payment service provider is used, that provider's own terms and conditions may also apply.

Payment is generally due upon completion of the order or in accordance with the terms of the selected payment method.

8. Retention of Title

The goods remain our property until the purchase price has been paid in full.

For business customers, the applicable statutory provisions relating to retention of title apply additionally.

9. Shipping and Delivery Areas

Delivery is made exclusively to the shipping address provided during the ordering process and within the delivery areas enabled in our online store.

Collection in person is currently not available.

The countries and shipping options currently available are displayed in our online store or at the latest during checkout.

We may use shipping, logistics and fulfilment service providers to perform our contractual obligations.

10. Delivery Times

Delivery times may vary depending on the product, destination country, warehouse location, shipping provider and other circumstances.

The delivery periods stated in our online store are estimated delivery periods unless a binding delivery date has expressly been agreed.

We make reasonable efforts to deliver orders within the stated delivery periods.

If unforeseen delays occur, we will inform the customer where corresponding information is available to us.

Mandatory statutory rights in the event of delayed delivery remain unaffected.

11. Partial Deliveries

If an order contains several products, the products may be delivered in separate packages or partial shipments, particularly where they are dispatched from different warehouse or fulfilment locations.

Customers will not incur additional shipping charges as a result unless such charges were expressly agreed before the order was placed.

12. Transfer of Risk

For consumers, the risk of loss of or damage to the goods generally passes only when the goods are handed over to the consumer or to a third party designated by the consumer.

This does not apply where the consumer has independently entered into a transport contract with a carrier that was not offered by us, to the extent otherwise provided by law.

For business customers, the applicable statutory provisions regarding transfer of risk apply.

13. Undeliverable Shipments and Incorrect Shipping Addresses

Customers are responsible for providing a complete and correct shipping address when placing an order.

If a shipment is returned to us or to one of our shipping or fulfilment partners due to an address provided incorrectly or incompletely through the customer's fault, or due to a culpable failure to accept delivery, we may charge the reasonable and actual costs of reshipping where legally permitted.

This does not apply where the failed delivery was caused by us or by a company acting on our behalf, or where the customer was not responsible for the failure to accept delivery.

14. Statutory Right of Withdrawal for Consumers

Consumers generally have a statutory 14-day right of withdrawal in relation to distance contracts, unless a statutory exception applies.

Details regarding:

  • commencement and duration of the withdrawal period
  • exercising the right of withdrawal
  • consequences of withdrawal
  • returning goods
  • refunds
  • return shipping costs
  • statutory exceptions to the right of withdrawal

can be found in our separate Withdrawal and Return Policy.

Statutory withdrawal rights are not restricted by these Terms and Conditions.

15. Returns

Please contact us before returning goods at:

info@amyandco.shop

so that we can provide you with the return information applicable to your order.

Contacting us before a return does not restrict a consumer's statutory right of withdrawal.

Where possible, products should be returned complete and with any accessories supplied with them.

Statutory rights remain unaffected.

16. Warranty

Statutory warranty provisions apply.

For consumers, the mandatory provisions of Austrian consumer warranty law apply in particular.

Statutory warranty rights are not excluded or restricted by these Terms and Conditions.

Warranty rights relate, in particular, to defects that were present or legally deemed to have existed at the time the goods were handed over, in accordance with applicable law.

Additional voluntary guarantees apply only where they have been expressly granted for a particular product.

Any manufacturer's guarantee does not affect statutory warranty rights against Amy & Co.

17. Inspection and Notification Duties for Business Customers

Where the customer is a business customer, the applicable statutory commercial rules regarding inspection of goods and notification of defects apply, including Sections 377 et seq. of the Austrian Commercial Code (UGB), where applicable.

These inspection and notification obligations do not apply to consumers.

18. Liability

We are liable in accordance with applicable law.

Any limitation of liability does not apply in particular to damage resulting from injury to life, body or health or in cases of intentional or grossly negligent conduct, where liability exists under applicable law.

Mandatory statutory liability provisions, including product liability and consumer protection legislation, remain unaffected.

For business customers, liability for damage caused by slight negligence may, where legally permissible, be limited to foreseeable damage typical of the contract.

No exclusion of liability is agreed to the extent that such exclusion would be prohibited by law.

19. Product Use and Safety

Products offered by us must be used in accordance with their intended purpose and any instructions for use provided with them.

For pet products in particular, customers should ensure that the product is the correct size, properly fitted, regularly inspected for wear and tear and used under appropriate supervision depending on the type of product.

Damaged products should not continue to be used if doing so could pose a risk to people or animals.

Mandatory statutory product safety and liability provisions remain unaffected.

20. Intellectual Property

Content contained in our online store, including text, graphics, photographs, videos, logos, designs and other materials, may be protected by copyright, trademark rights or other intellectual property rights.

Any use beyond that permitted by law generally requires the prior consent of the relevant rights holder.

The name and brand Amy & Co., together with related marks and identifiers, may not be used for commercial purposes without appropriate authorisation.

Third-party rights, including rights relating to product images, trademarks and other supplied materials, remain unaffected.

21. Product Reviews and User-Generated Content

Where customers voluntarily submit or publish reviews, images or other content through review functions provided by us, such content must be lawful and must not infringe the rights of third parties.

The customer confirms that they hold all rights necessary to provide the submitted content.

To the extent necessary to display a review, the customer grants us a simple, royalty-free right to use voluntarily submitted content in connection with our online store and the presentation of our products.

Personality rights, copyright and data protection rights remain unaffected.

22. Prohibited Use of the Online Store

Our online store may not be used unlawfully or abusively.

In particular, users must not:

  • distribute unlawful or harmful content
  • transmit malware or other malicious software
  • circumvent security mechanisms
  • collect personal data of other persons without authorisation
  • interfere with the online store through automated or other attacks
  • infringe our rights or the rights of third parties

We may restrict access to certain functions to the extent legally permissible where necessary to protect the online store, our customers or third parties.

23. Shopify and Other Technical Service Providers

Our online store is technically operated using Shopify.

However, purchase contracts relating to products offered by us are generally concluded between the customer and Denise Tröstner, trading as Amy & Co.

Shopify is not the seller of products offered by Amy & Co.

We may use additional technical, payment, shipping, review or other service providers for individual functions of the online store.

Information regarding the processing of personal data can be found in our Privacy Policy.

24. Electronic Communications and Invoices

Contract-related communications may be sent to the email address provided by the customer.

Where legally permissible, invoices and other contractual documents may be provided electronically, in particular by email or through the relevant functions of the online store.

Customers are responsible for providing a correct and accessible email address.

Mandatory statutory formal requirements remain unaffected.

25. Data Protection

Information regarding the processing of personal data can be found in our separate Privacy Policy.

26. Governing Law

Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent that this does not conflict with mandatory statutory provisions.

For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has their habitual residence.

27. Jurisdiction

For consumers, the statutory rules regarding jurisdiction apply.

Any jurisdiction agreement must not restrict mandatory consumer rights.

For contracts with business customers, the court having subject-matter jurisdiction at the place of business of Amy & Co. shall have jurisdiction to the extent legally permissible.

28. Alternative Dispute Resolution

We aim to resolve any disagreements with our customers directly and amicably wherever possible.

Amy & Co. is not currently committed to participating in an alternative dispute resolution procedure before a consumer arbitration body, unless participation is required by applicable law.

If a dispute with a consumer cannot be resolved directly, we will provide any information regarding competent alternative dispute resolution bodies that is required by applicable law.

You can contact us at:
info@amyandco.shop

29. Invalidity of Individual Provisions

If any provision of these Terms and Conditions is wholly or partially invalid or unenforceable, the validity of the remaining provisions will remain unaffected to the extent permitted by law.

The applicable statutory provisions shall apply in place of any invalid provision.

30. Changes to These Terms and Conditions

We may amend these Terms and Conditions for future contracts where necessary, in particular due to changes in legal requirements, our products or our business processes.

For contracts already concluded, the version of these Terms and Conditions agreed at the time the relevant contract was entered into will generally continue to apply, unless otherwise expressly and validly agreed.

The current version of these Terms and Conditions is available in our online store.
